1. Agreement to Terms

By accessing or using Daily Vocabulary ("Daily" or the "App"), provided by Element.co ("we", "us", or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Use of the App

Daily is a vocabulary-learning app that provides daily word practice, progress tracking, social features, and optional AI-powered voice coaching. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

You agree not to:

• Use the App for any illegal or unauthorized purpose;
• Attempt to hack, destabilize, reverse engineer, or adapt the App's source code, except where applicable law permits it;
• Upload, post, or submit content that infringes on third-party intellectual-property or privacy rights;
• Upload, post, or submit content that is defamatory, libelous, slanderous, obscene, pornographic, sexually explicit, harassing, threatening, abusive, hateful, discriminatory, or otherwise offensive, illegal, or highly objectionable.

3. User Content and Community Safety

Daily includes social and interactive features, such as usernames, squads, and friends, where users may submit or display content ("User Content"). You retain ownership of your User Content, but grant us a worldwide, non-exclusive, royalty-free license to use, store, and display it only as needed to operate the App and its social features.

We may remove User Content or suspend or terminate accounts that violate these Terms. The App provides built-in reporting and blocking tools. You can report objectionable content or users through the user actions menu, and you can block a user to prevent interaction with you. We review reports under our moderation process.

4. Subscriptions and Payments

Daily offers a free version and an optional auto-renewing Daily Pro subscription. Daily Pro provides access to premium features, including AI Voice Coaching, real-world practice scenarios, and additional coach personas. The current price, subscription length, and any introductory offer are shown in the App before you confirm a purchase.

• Billing: Purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms and conditions.
• Automatic renewal: Your subscription automatically renews unless you cancel it at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours before the end of the current period.
• Management and cancellation: You can manage your subscription and turn off auto-renewal in your Apple App Store or Google Play Store account settings after purchase.
• Free trials: If an introductory free trial is offered, any unused portion ends when you purchase a subscription, where applicable.
• Refunds: Refund requests must be directed to the applicable app store.

5. AI Features

The App may include AI-powered features, including voice coaching and feedback. AI-generated responses may be inaccurate, incomplete, or inappropriate and are provided for educational purposes only. Do not rely on them as professional, medical, legal, financial, or other expert advice.

6. Intellectual Property

Except for User Content, the App and its content, features, design, and software are owned by Element.co or its licensors and are protected by applicable intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the App for its intended purpose.

7. Disclaimer and Limitation of Liability

The App is provided on an "as is" and "as available" basis, without warranties of any kind, to the extent permitted by law. Element.co will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App.

8. Privacy Policy

Your use of the Application is also governed by our Privacy Policy, which is incorporated by reference and can be accessed at: https://www.privacypolicies.com/live/9896880d-f931-4566-ae5e-0ad3fa76b7e4.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of South Africa, without regard to its conflict-of-law provisions.

10. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last Updated" date. Your continued use of the App after an update means you accept the updated Terms.

12. Apple App Store Terms

For users who obtain the App through the Apple App Store, these Terms are concluded between you and Element.co, and not with Apple. Element.co, not Apple, is solely responsible for the App, its content, and any maintenance or support for it.

To the maximum extent permitted by applicable law, Apple has no warranty obligation for the App. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the App, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.

Element.co, not Apple, is responsible for addressing claims relating to the App or your possession or use of it, including product-liability claims, claims that the App does not comply with applicable legal or regulatory requirements, consumer-protection claims, and claims that the App infringes a third party's intellectual-property rights.

You must comply with applicable third-party terms when using the App. You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on a U.S. Government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of these Terms for App Store users. Upon your acceptance of these Terms, Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
